ADWR Regulatory Agenda
This agenda was produced by the Arizona Department of Water Resources (“ADWR”) to comply with A.R.S. § 41-1021.02.
Pursuant to A.R.S. § 41-1021.02(D), ADWR may undertake a rulemaking even if the rulemaking is not included on the annual regulatory agenda.
Note: Pursuant to A.R.S. § 41-1039, as of December 1, 2025, ADWR has not requested permission to conduct any rulemaking in 2026.
- Anticipated 2026 Rulemaking Activity
Pursuant to A.R.S. § 45-465.05(G), no later than June 30, 2026, ADWR is required to adopt rules through an expedited rulemaking to set licensing timeframes for issuance of groundwater savings credits and to provide for a “summary process” for a designated provider to pledge groundwater savings credits to a designation. (Prior to adoption of the rulemaking, ADWR will continue to process relinquishment applications and issue groundwater savings credits, and will also allow municipal providers to pledge groundwater savings credits during the designation modification process.) - Reviews of Existing Rules Due in 2026
All of ADWR’s rules (Arizona Administrative Code, Title 12, Chapter 15) are subject to review in ADWR’s Five-Year
Review Report, which is due to the Governor’s Regulatory Rule Commission by February 27, 2026. - Rulemakings Terminated in 2025

- Anticipated 2025 Rulemaking Activity
In January 2025, ADWR will initiate a stakeholder process to discuss an approach to conversion of agricultural lands for assured water supply purposes, including the potential for a physical availability exemption credit and the conditions under which such an exemption credit may be issued and used for assured water supply determinations. As stakeholder discussions progress, with the approval of the Governor, ADWR may initiate a rulemaking docket if rule language is to be developed.
