On November 29th, 2023, the Arizona Department of Water Resources (ADWR) provided the Governor’s Office with five policy recommendations from the Governor’s Water Policy Council. Among these recommendations was a proposed “Alternative Path to Designation of a 100-year Assured Water Supply” (ADAWS). The ADAWS rulemaking seeks to address challenges that some water providers face in pursuing a new Designation of 100-year Assured Water Supply (DAWS) under the current rules. ADWR may amend its Rules found in Arizona Administrative Code, Title 12, Chapter 15, Article 7 and specifically the following rules: R12-15-701, R12-15-704, R12-15-710, R12-15-711, R12-15-720, and R12-15-724. The initial proposed draft amendments can be found here. During the informal rulemaking process, ADWR sought feedback, either written or verbal, from stakeholders regarding the proposed amendments until the May 3, 2024, deadline. Stakeholders were welcome to provide written comments using the submission form to the right, or by providing verbal comments at one of the three stakeholder meetings hosted by ADWR on April 22, 2024, May 1, 2024, and July 26, 2024. On August 7, 2024, the formal rulemaking process was initiated by filing a Notice of Docket Opening and Notice of Proposed Rulemaking for ADAWS, and a separate Notice of Docket Opening and Notice of Proposed Rulemaking for commingling for certificates, with the Secretary of State's Office. ADWR will continue to update this page when additional documents are ready to share. On November 22, 2024 the Governor's Regulatory Review Council approved the rules, as submitted on October 7, 2024, with an immediate effective date upon filing with the Secretary of State. ADWR filed with the Secretary of State it's Notice of Final Rulemaking on November 25, 2024. The effective date of this rulemaking is November 25, 2024
