Prescott Active Management Area Fourth Management Plan

       

    

On May 14, 2014, Michael J. Lacey, Former Director of the Arizona Department of Water Resources (Department), issued the Proposed Management Plan for the Prescott Active Management Area for the Fourth Management Period, 2010 to 2020 (Proposed Plan).  The Department held a public hearing on the Proposed Plan at the Prescott Valley Library on June 27, 2014.  At the hearing the Department gave a presentation and accepted comments on the Proposed Plan.   The Department also accepted written comments on the Proposed Plan from May 14, 2014 until 5:00 P.M. on June 27, 2014.  A copy of the transcript from the June 27, 2014 public hearing is available here.  A copy of the Proposed Plan is available below.

 

On July 28, 2014, Michael J. Lacey, Director of the Department (Director), filed in the Department a written Summary of Hearing and Findings with respect to matters considered during the public hearing on the Proposed Plan.  The Summary of Hearing and Findings is available here.  The Summary of Hearing and Findings indicated, and the Director determined, that some modifications to the Proposed Plan were necessary.  Also on July 28, 2014, the Director entered an order adopting the Management Plan for the Prescott Active Management Area for the Fourth Management Period, 2010 to 2020 (Fourth Management Plan) and describing the modifications made to the Fourth Management Plan.  The Order of Adoption is available here

 

The Fourth Management Plan, available below, contains mandatory conservation, monitoring, and reporting requirements for certain persons withdrawing, distributing, or receiving groundwater within the Prescott Active Management Area (PRAMA).  These requirements which are set forth in the Agricultural Conservation Program, the Municipal Conservation Program, and the Industrial Conservation Program of the plan, are designed to achieve reductions in withdrawals of groundwater within the PRAMA.  The Fourth Management Plan also includes a Groundwater Quality Management Program, an Augmentation and Recharge Program, a Water Management Assistance Program, an introductory chapter and chapters discussing water resources, water use characteristics, groundwater quality, plan implementation, water budgets and projections, and water management strategy.

 

Copies of the Fourth Management Plan, the Summary of Hearing and Findings, and the Order of Adoption are available for viewing at the Department’s office in Phoenix, as well as the following libraries located in the PRAMA: Prescott Public Library, Prescott Valley Public Library, Yavapai College Library, Chino Valley Public Library, and the Dewey-Humboldt Town Library.  A person may request a copy of any of the aforementioned documents in either paper or electronic format by contacting Sharon Scantlebury at (602) 771-8472 or [email protected].  

 

Pursuant to section 45-114(C) of the Arizona Revised Statutes, any person may file a motion for rehearing or review of the Director’s order adopting the Fourth Management Plan.  However, a party is not required to file a motion for rehearing or review in order to exhaust administrative remedies and may seek judicial review once the Director’s decision becomes final.  Any motion for rehearing or review must be filed with the Docket Supervisor, Arizona Department of Water Resources, 3550 North Central Avenue, Phoenix, AZ 85012 by Friday, September 26, 2014 at 5:00 P.M.  If no person files a timely motion for rehearing or review, the July 28, 2014 Order of Adoption will become final on Saturday, September 27, 2014.  If any person files a timely motion for rehearing or review, the Director will issue a decision on the request and may modify the Fourth Management Plan after rehearing or review.  After the Director issues decisions on all motions for rehearing or review, the Director will publish notice that the Fourth Management Plan is final once each week for two consecutive weeks in the Prescott Daily Courier.  The notice will include a description of any modifications made after rehearing or review.  The Fourth Management Plan will be final for purposes of judicial review when the notice is published for the second time.
